1. Acceptance of Terms
By accessing or using Brand Audit ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use the Service. These terms apply to all users, including visitors, registered users, and paying subscribers.
2. Description of Service
Brand Audit is an AI-powered brand intelligence platform that analyses brand positioning, voice, differentiation, and competitive standing across eight strategic frameworks. Reports are generated using publicly available brand signals and AI analysis. Results are provided for informational and strategic planning purposes only and do not constitute professional marketing, legal, or financial advice.
3. Account Registration
To access paid features, you must create an account with accurate and complete information. You are responsible for:
- Maintaining the confidentiality of your login credentials
- All activity that occurs under your account
- Notifying us immediately of any unauthorised access
- Ensuring your contact email address remains valid
4. Subscription, Billing & Refunds
Paid plans are billed monthly or annually in advance. By subscribing, you authorise us to charge your payment method on a recurring basis. Prices are listed in USD and are subject to change with 30 days’ notice to existing subscribers.
Cancellations take effect at the end of the current billing period. You will retain full access until that date.
Refunds are available only if both conditions are met: (a) the refund is requested within 24 hours of payment, and (b) no brand audit report has been generated under the account during the billing period. For full details, see our Cancellation & Refund Policy.
5. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose or in violation of any applicable regulations
- Attempt to reverse-engineer, scrape, or copy our AI models or proprietary methodologies
- Resell or sublicense the Service without our express written permission (except as permitted by Agency plan terms)
- Submit false or misleading brand information to manipulate analysis results
- Use automated scripts or bots to generate reports in bulk beyond your plan limits
6. Intellectual Property
All content, software, AI methodologies, frameworks, and design elements of Brand Audit are owned by or licensed to us. You retain ownership of the brand data you submit. We are granted a limited licence to process that data solely to deliver the Service. Generated reports are licensed to you for internal business use. White-label reports (Agency plan) may be shared with your clients.
7. Disclaimer of Warranties
The Service is provided "as is" without warranties of any kind. We do not guarantee that analysis results are complete, accurate, or suitable for any particular business decision. AI-generated insights are probabilistic in nature and should be reviewed critically alongside other market research.
8. Limitation of Liability
To the maximum extent permitted by law, Brand Audit shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability to you for any claim shall not exceed the fees paid by you in the three months preceding the claim.
9. Termination
We reserve the right to suspend or terminate your account if you violate these Terms. You may cancel your account at any time from your billing settings. Upon termination, your access to the Service will cease and your data will be deleted in accordance with our Privacy Policy.
10. Changes to Terms
We may update these Terms from time to time. We will notify you of material changes by email or by displaying a notice within the Service. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.
11. Governing Law & Dispute Resolution
These Terms are governed by the laws of India. Any disputes arising under or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts in Hyderabad, Telangana, India.
For consumer disputes, Indian users may also approach the relevant Consumer Disputes Redressal Forum under the Consumer Protection Act, 2019.
12. Grievance Redressal (India)
In accordance with the Information Technology (Intermediary Guidelines and Digital Media Ethics Code) Rules, 2021, we have designated a Grievance Officer to address complaints from users in India:
